Terms of Service Last Updated: June 14, 2026

  1. Agreement to Terms By downloading, accessing, or using Phasely (“Phasely,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”), which form a binding agreement between you and Karolina Bittman, operating Phasely as an individual founder based in Zürich, Switzerland. If you do not agree, do not use the application or services. Phasely is operated from Zürich, Switzerland.

  2. Description of Service Phasely is a digital wellness application that provides: Menstrual cycle tracking and phase estimation Cycle-aware fasting guidance Nutrition and exercise recommendations An AI-powered wellness coach (the “AI Coach”) Meal photo logging with AI-generated nutritional analysis and cycle-aware insights Educational content related to women’s health, hormonal transitions, and metabolic health Phasely is an educational tool and does not provide medical services.

  3. No Medical Advice Phasely does not provide medical advice, diagnosis, or treatment. All information provided through the app, including AI-generated content, is for educational purposes only. You must always consult a qualified healthcare professional before: Starting or changing a fasting routine Changing diet or exercise habits Making decisions related to hormonal health Managing medical conditions, including autoimmunity, thyroid disorders, or hormonal imbalances Taking nutritional supplements, herbs, or alternative therapies discussed in the application Use of Phasely does not create a doctor-patient relationship.

  4. AI Coach Disclaimer Phasely includes an AI-powered assistant (“AI Coach”) and meal photo analysis powered by third-party AI services. You acknowledge and agree that: AI-generated content may be inaccurate, incomplete, or outdated AI responses are not medical advice AI does not replace professional healthcare guidance Phasely does not guarantee the accuracy of AI outputs AI processing involves third-party providers (Anthropic, OpenAI), as described in our Privacy Policy We strongly recommend verifying important health-related information with a qualified professional.

  5. Eligibility Phasely is intended for users aged 18 and older. Phasely is not designed for use by: Pregnant, breastfeeding, or planning pregnancy Individuals with a history of eating disorders, including anorexia, bulimia, binge eating disorder, or orthorexia Individuals with diabetes (Type 1 or Type 2) requiring medication management Individuals with untreated thyroid conditions or active autoimmune conditions affecting metabolism, hormones, or gut function Individuals with cardiovascular conditions or blood pressure disorders Individuals taking medications that require consistent food intake Individuals using hormonal contraception that suppresses natural menstrual cycles Individuals whose healthcare provider has advised against fasting, caloric restriction, or significant dietary changes By using Phasely, you confirm that you meet these eligibility requirements.

  6. User Accounts To use Phasely, you must create an account using an email and password. You are responsible for: Maintaining the confidentiality of your credentials All activity occurring under your account Providing accurate and complete information Notifying us immediately of any unauthorized access We reserve the right to suspend or terminate accounts that violate these Terms.

  7. Subscriptions and Payments

Note: Only the Free Plan is currently available. Monthly Subscription, Annual Subscription, and Lifetime Access are planned for a future release and not yet offered. This Terms of Service describes the full intended subscription model so users understand what is planned.

Phasely offers the following plans: Free Plan — Limited access to features, including 10 AI Coach queries total Monthly Subscription — Recurring monthly billing Annual Subscription — Recurring annual billing Lifetime Access — One-time payment, limited promotional offer Pricing, current subscription terms, and any promotional offers are displayed within the application before purchase and on the App Store listing. Payment, Billing, and Renewal: All payments are processed exclusively through the Apple App Store Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period You can manage your subscription and turn off auto-renewal by going to your Apple ID Account Settings after purchase No cancellation of the current subscription is allowed during the active subscription period Refunds: All refund requests must be made directly to Apple through your Apple ID Account. Phasely does not have the ability to issue refunds directly. Where required by law (including EU consumer protection laws), users have additional refund rights. Swiss and EU consumers have a 14-day right of withdrawal from digital service contracts. By starting to use the Service immediately upon purchase, you may waive this right of withdrawal under EU/Swiss law for the digital content portion of the subscription. Lifetime Access: “Lifetime Access” means access for the operational lifetime of the Phasely Service. If we discontinue the Service, Lifetime Access subscriptions will not be refunded beyond what is legally required. Pricing Changes: We may modify subscription pricing for new subscribers at any time. Existing subscribers will not be affected by price increases during their current billing period. We will provide reasonable notice of any pricing changes through the application or via email.

  1. Acceptable Use You agree not to: Use Phasely as a substitute for professional medical advice or treatment Misuse AI outputs as clinical advice Attempt to reverse engineer, decompile, or disassemble the application Attempt to make the AI Coach generate harmful, illegal, or discriminatory content Use the AI Coach to seek advice for medical emergencies (call emergency services instead) Submit content that violates the rights of others, including personal information about third parties Submit harmful, abusive, defamatory, obscene, or illegal content Attempt to extract, copy, or replicate the underlying knowledge base or AI prompts Use the Service to develop a competing product Use automated tools, scrapers, or bots to access the Service Use the Service in a way that could harm other users or third parties Use the Service in violation of any applicable law

  2. Intellectual Property Our Intellectual Property: All rights, title, and interest in Phasely, including but not limited to the software, design, user interface, branding, the curated knowledge base, AI system prompts, retrieval algorithms, and educational content (excluding user-generated input), are owned by Phasely and its operator. These rights are protected by Swiss, European, and international intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Phasely application for personal, non-commercial purposes, subject to these Terms. Your Content: You retain ownership of any content you submit to the Service, including messages to the AI Coach, meal photos, and personal data you provide. By submitting content, you grant Phasely a non-exclusive, worldwide, royalty-free license to: Process, store, and display your content as necessary to operate the Service Use anonymized and aggregated content to improve the Service Share content with our third-party AI providers (Anthropic, OpenAI) solely as needed to generate responses This license expires when you delete the content or terminate your account. We do not claim ownership of your content. We do not use your individual identifiable content for marketing, advertising, or training of third-party AI models. Restrictions: You may not: Reverse engineer, decompile, or disassemble the application Remove or alter any copyright, trademark, or proprietary notices Copy, modify, distribute, sell, or lease any part of the Service Use the Service to build, train, or improve any competing AI system

  3. Health and Safety Disclaimer You acknowledge that: Fasting, dietary changes, and exercise programs may carry health risks Individual responses vary significantly Phasely does not guarantee any health outcomes You are responsible for monitoring your own well-being If you experience any adverse symptoms — including but not limited to dizziness, fainting, persistent fatigue, chest pain, irregular heartbeat, severe headaches, or symptoms of low blood sugar — you should stop use immediately and consult a healthcare professional. In case of medical emergency, contact emergency services. Do not rely on Phasely for emergency medical guidance.

  4. Content Submitted to the AI Coach The AI Coach processes content you submit. You agree that any content you submit: Is your own or you have the right to share it Does not contain personal information about others without their consent Does not include illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable content Does not infringe on the intellectual property rights of others Does not contain malicious code, attempts at prompt injection, or other adversarial inputs We reserve the right to: Decline to process content that violates these Terms Suspend or terminate accounts of users who repeatedly submit prohibited content Cooperate with law enforcement when required by law Reporting concerns: If you encounter AI Coach responses that you believe are harmful, inaccurate, or inappropriate, please report them through the in-app feedback mechanism or contact hello@phasely.today.

  5. Limitation of Liability To the maximum extent permitted by applicable law: Phasely, its founder, contributors, and affiliates shall not be liable for any: Direct, indirect, incidental, special, consequential, or punitive damages Health outcomes, injuries, or medical conditions arising from use of the Service Loss of profits, data, use, goodwill, or other intangible losses Damages resulting from your reliance on AI-generated content Damages resulting from your reliance on cycle phase calculations or fasting recommendations Damages resulting from any decisions you make based on information from the Service Damages from service interruptions, errors, or unavailability Damages from unauthorized access to your account or data Where liability cannot be excluded by law, our total liability for any claim arising from these Terms or your use of the Service is limited to the greater of: The amount you paid to Phasely in the 12 months preceding the claim, or 100 Swiss Francs (CHF 100) You use the Service at your own risk. Nothing in these Terms excludes or limits liability for: Gross negligence or willful misconduct Death or personal injury caused by negligence where such limitation is prohibited by law Fraud or fraudulent misrepresentation Any other liability that cannot be excluded or limited under Swiss law

  6. Consumer Rights (EU and Swiss Users) If you are a consumer based in the European Union, European Economic Area, United Kingdom, or Switzerland, you have certain statutory rights that cannot be waived by these Terms, including: Statutory warranty rights for digital products Right of withdrawal within 14 days of purchase for distance contracts (subject to limitations for digital content) Rights related to defective goods or services Right to lodge complaints with consumer protection authorities Nothing in these Terms limits these statutory rights. For users in the EU: You may also be able to submit complaints to the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr For users in Switzerland: You may contact the Swiss Consumer Protection Foundation (SKS) at https://www.konsumentenschutz.ch

  7. Indemnification You agree to indemnify and hold harmless Phasely, its founder, contributors, and affiliates from any claims, damages, costs, or liabilities (including reasonable legal fees) arising from: Your use of the Service Your violation of these Terms Your violation of any third-party rights Your reliance on AI-generated outputs Your health decisions made based on information from the Service

  8. Modifications to the Service We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes: Adding or removing features Changing the AI Coach’s underlying technology or knowledge base Updating the user interface Discontinuing the Service entirely We will provide reasonable notice through the application for material changes that affect paid subscribers. If the Service is permanently discontinued, we will provide reasonable opportunity for users to export their data, in accordance with our Privacy Policy.

  9. Termination By you: You may stop using Phasely at any time by: Uninstalling the application Canceling your subscription through your Apple ID account Deleting your account through Settings → Delete Account Upon account deletion, your personal data will be handled in accordance with our Privacy Policy. By us: We may suspend or terminate your account or access to the Service if: You violate these Terms We are required to do so by law or court order Your account remains inactive for an extended period (with notice) We discontinue the Service Upon termination: Your access to paid features ends immediately Your data will be deleted in accordance with our Privacy Policy and applicable retention requirements Sections of these Terms that by their nature should survive termination shall survive (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) If your subscription is terminated due to violation of these Terms, no refund will be issued.

  10. Governing Law and Jurisdiction These Terms are governed by the laws of Switzerland, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Zürich, Switzerland. However: If you are a consumer residing in the European Union, European Economic Area, United Kingdom, or another jurisdiction with mandatory consumer protection laws, you may also bring claims in the courts of your country of residence, and the consumer protection laws of your jurisdiction will apply where mandatorily required.

  11. Changes to These Terms We may update these Terms from time to time to reflect changes in our practices, legal requirements, or service offerings. When material changes occur, we will: Update the “Last Updated” date at the top of these Terms Provide reasonable notice within the Service (such as an in-app notification or email) at least 30 days before changes take effect For changes that materially reduce your rights, provide an opportunity to cancel your subscription before the changes take effect Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may cancel your subscription.
